U.S. Education Department Releases Guidance on Education of Children with Disabilities Attending Public Virtual Schools (August 2016)

The U.S. Department of Education’s Office of Special Education and Rehabilitative Services (OSERS) issued a “Dear Colleague” Letter to states to ensure students with disabilities attending public virtual schools are getting the special education and supports required by the Individuals with Disabilities Education Act (IDEA). Public virtual schools are becoming more common so it is important that the rights and protections guaranteed to students with disabilities are not diminished or compromised in this education setting. This letter clarifies the role and responsibility that they have in ensuring that students with disabilities have access to a free and appropriate public education in the least restrictive environment.
